So hat die Polizei in den zwölf Stunden (3:30-15:30), die der Kaltluftgewahrsam im Freien in Harlingen andauerte, nur bei einem Bruchteil der zunächst 1.300 Festgehaltenen überhaupt versucht, einen richterlichen Beschluss über die Zulässigkeit der Ingewahrsamnahme zu erwirken. Das widerspricht klar dem Grundgesetz und der Rechtsprechung des Bundesverfassungsgerichts, wonach jede Freiheitsentziehung ‚unverzüglich‘ von einem Richter bestätigt werden muss. Die meisten Fälle, welche die Polizei überhaupt dem Amtsgericht Dannenberg vorlegte, reichte sie dort nach Auskunft des Gerichts erst am Nachmittag ein, also über zehn Stunden nach Beginn der Ingewahrsamnahme. Die Polizei lügt, wenn sie behauptet, sie habe die GleisbesetzerInnen „nach und nach“ einem Richter vorgeführt (PM der Polizei vom 27.11., 12:21 Uhr). Tatsächlich hat sie bewusst eine
richterliche Überprüfung des Kaltluftgewahrsams verhindert, um Tausende von AtomkraftgegnerInnen widerrechtlich stundenlang in der Kälte festzuhalten. Nach Berichten von Anwälten war dies sogar eine explizite Anweisung der Polizeieinsatzleitung.
